La criminalisation de l\u2019agression et l\u2019\u00e9tablissement de la comp\u00e9tence de la Cour p\u00e9nale internationale sur ce crime obligent \u00e0 donner une d\u00e9finition de ce crime, de m\u00eame qu\u2019\u00e0 d\u00e9terminer les conditions dans lesquelles la Cour exercera sa comp\u00e9tence sur ce crime. Cette t\u00e2che n\u2019est cependant pas ais\u00e9e en raison de la \u00ab nature particuli\u00e8re \u00bb du crime d\u2019agression. Le probl\u00e8me majeur qui se pose est celui de la difficult\u00e9 \u00e0 d\u00e9finir et \u00e0 encadrer le crime d\u2019agression tout en respectant les r\u00e8gles cardinales du droit international p\u00e9nal d\u2019un c\u00f4t\u00e9 et les exigences du droit de la Charte ou du droit international du maintien de la paix de l\u2019autre c\u00f4t\u00e9.En raison de la nature juridique de l\u2019agression et plus pr\u00e9cis\u00e9ment du positionnement atypique qui caract\u00e9rise le crime d\u2019agression, crime \u00e0 la crois\u00e9e du droit international du maintien de la paix et du droit international p\u00e9nal, sans oublier le fait que ce crime vise exclusivement les personnes \u00ab effectivement en mesure de contr\u00f4ler ou de diriger l\u2019action politique ou militaire d\u2019un \u00c9tat \u00bb, le r\u00e9gime juridique du crime d\u2019agression va \u00eatre assez particulier, ceci en comparaison de celui des autres crimes internationaux contenus dans le Statut de Rome.<\/p>\n

Abstract<\/strong><\/span><\/h2>\n

he criminalization of aggression and the establishment of the International Criminal Court\u2019s jurisdiction over this crime make it necessary to provide a definition for this crime, and to determine the conditions under which the Court shall exercise its jurisdiction over this crime. However, this task is not an easy one given the \u2018\u2019particular nature\u2019\u2019 of the crime of aggression. The major challenge we are faced with lies in the difficulty to define and circumscribe the crime of aggression while abiding by the cardinal rules of international criminal law on the one hand, and the requirements of the law of the Charter or the law of the international Peacekeeping on the other. Due to the legal nature of the aggression, more precisely the atypical positioning characteristic of the crime of aggression, a crime which is halfway between the law of the international peacekeeping and the international criminal law, not forgetting the fact that this crime targets exclusively individuals who are \u2018\u2019 actually able to control or lead the political or military action of a State,\u2019\u2019 the legal regime of the crime of aggression is going to be fairly peculiar, in comparison with that of the other international crimes provided for by the Rome Statute.<\/p>\n
